The responses on how to treat infringers were interesting to say the least. I realize that the infringers are wrong and I realize that many of them will whine and cry and complain about being picked on because of what they did. Those are the same ones that try to get others to help them justify what they did. Does not matter, they know what they did and no matter what they say or do it will not change the simple fact that they took something they did not own for their own use.
You need to consider many things when you pursue a copyright infringement. The only ones I am personally approving for legal action right now are the ones that do not try to work something out or the ones that ignore what they have done. Right now, today I had 4 more Pinterest and two new businesses added to the list. Even with the work I am doing I am losing ground. You have to pick the ones that hurt your property. The courts really look down on things that injure the image. The main things that do that are using it for things that might be illegal, the ones that changed the look of the image and of course the ones that added copyright notices or watermarks illegally to the images. I am working to get all the commercial infringements at least started this year. Sounds like a long time but the allowances for responses and notices takes time. What you have to do is to remember, it does not matter where they go, what they do with their assets the courts can find them and hiding things is not a good way to get a judge on their side.
About who reads the articles, well that is something I have no comment on as I get no information about who reads it. I get an idea from the countries and what articles they read but more information comes from the questions I get. So the answer about the actual infringers reading the articles is I have no idea. 32 could be reading this everyday or may never have read it. I do not know.
The infringed photos gallery on my PhotoShelter site has some of the infringed images. The one open to the public had 2 images but now more have been added. It is not done as more will be added as time goes forward. They are going up for students to look at and will not be posted anywhere else right now.
The photo for this article shows how many different sizes of the one photo have been added to the web. I was too concerned about building something that was not wanted to pay attention to my work being violated this way. I was up to 2:30 am working with a magazine to remove my images put up by someone else. Before you ask, I have no concern about it being 32. It has happened during the time frame but I do not see any connection at all. That may change as I say about things, but I see nothing to make me believe that there is any chance of any new connection. The magazine is a start up that is part of the 8020 Media group.
One other thing for the infringers if they read this, do not be fooled by others or attorneys that say you can get fair use and nothing else matters. First off, if an attorney tells you that you qualify for Fair Use, run out of the office. No one can do that but the judge. Second, the DMCA is a separate law from the Copyright Act of 1976. The CMI part does not require any copyright infringement just like the civil and criminal cases are independent and do not require any action other than their own. I can take 32 to criminal court and never file anything else. I can file for DMCA CMI for 1 or 32 images and never file anything else. I can file for copyright infringement and nothing else or file for all of them at the same time.
What some infringers think is that they are in charge or have options. They have limited options until the attorneys get involved then all the options are mine. They give up their options. They have no options left. It is my decision if they go to court. It is my decision what to file and it is my decision on what to accept from them or their attorney not theirs.
