Fair Use gets hammered. First things first. The Federal District Court just hammered Meltwater Press for taking AP’s work and making money off of it. This was on March 21, 2013. The “news” site and gatherer was claiming what they were doing was Fair Use. They were taking stories off AP’s website and posting a few sentences and reposting a line or two with a link. They claimed they were a search engine like Google. Did not convince anyone. A lot of the free everything crowd are complaining but there will always be those who do that. Complaining is all they know so they try to make it work. Google has purchased a license from AP, image that. One of Pinterest’s founders bailed for a consulting job. Would you leave a job that was supposedly going to make you a billionaire? The handwriting is on the wall people. Infringers are heading into a new era, it is called paying for the work you take. Just put it all together, a new federal court system, the two items mentioned above. Meltwater lost big in the UK but has it on appeal. Get out the checkbooks infringers. Settle things now even if you have not been contacted. That has saved some of the people I had take my work a lot of money.
This brings up something that has been brought to my attention concerning my work and Copysearch. I have someone that does that for me about once every two weeks or so. She also does some mailing for me and things. She is about a thousand miles away from Denver. She is a young girl that wanted to learn something about business . She is just turning 14. She is my grandniece. It means the mailings will be a little slower.
One of my posts came up in article search on a system much like Meltwater, it is called TOPIX. She and I both could only find one place on the search that Topix had the story. This is really kind of a strange thing but it is the Sun City West, Az Topix that had the story. There are 2 comments down under the comment box I did not notice but were pointed out to me. It is one of the infringing stories and comments. I took a quick glance but they seem strange in themselves. I did some work on the Topix Sun City West site because one of the visitors I had was referred from the Sun City West site but came in from Tucson. Well that put the Tucson question I had to bed. It was linked from Sun City West. Then it came out that other articles were floating and linking in Scottsdale and Tempe. The one we already know showed up from Glendale.
The investigator in me starting asking why when this was brought to my attention that CopySearch did not find them on other Topix sites. I have sent them an email but their initial response is that Topix posts things the way they want them done. Seems strange that the area being looked into now has the links that are showing the exact boundaries we were blocking . Just so the uninformed know, I cannot block Gmail accounts. Stating that we could block them in California or Arizona was a ploy. It worked. We go 4 in three days. Almost like someone making a statement. Bad move on their part. That is all I am going to say about that, but California may not be the culprit.
On to other matters, really would like to get to the front end of photography but unfortunately the backend is the most complicated and the one going through the changes and being abused by infringers.
The nice thing is that progress is being made on the infringers who has decided not to try the courts. Smart move, the one site cited me and the website instead of paying an invoice. They did not do it correctly but something is better than nothing. Some are just paying and other ask questions which is fine.
Now photographers are getting the idea of how much the business is not about shooting with the camera. The new digital age is changing everything and that includes photography and not necessarily in a good way. Like I said, real life examples and how they change almost everyday.
Another aspect of the business is the books. I got a phone call yesterday from a publisher to write a book on copyrights and photography. I had no interest but after talking to my brother about it, I may just do that. I got one from their sister company today about doing a color photo book since the first one is only text and a picture scattered around in it. Another thing taking time away from shooting. It is like the nonprofit, I was not supposed to be the Director, that was someone else’s job. I do not want it, I want to be in the field teaching not being a desk jockey.
