I was going to finish an article on the photo and perspective today but I got an inquiry last night that intrigued me and I thought it deserved careful consideration. With that said, it is not about the MONEY. If you get $ 3500.00 per photo for the CMI and fee one time that is ok, but in the lifetime of that image being licensed now days it could be several times that figure. Protect the work and the money will take care of itself.
The question came I guess in response to my article where I was venting a little after dealing with some ego driven less than knowledgeable infringers. Some people just have no clue.
I emailed a person today who has a part time commercial site that does not generate income of any kind, no selling, no advertising revenues or things like that. I emailed her at 8:10am and at 9:32am I received a reply email. She was willing to take the photo down. I told her that if she cited it and put a link to the website she could still use it.
I have a simple system right on how to choose who to bill and how much. I am doing the easiest right now. I am not going to bill everyone but I am billing more than I am not. The big items are if the photos or copyright were changed. That is the big one. Those hurt the images, sales and further use as many are being made available for sale in different venues. If they are deriving income of any sort they are getting billed. The normal fees right now are based on the usage by 6 month intervals. They do get billed the standard rate plus per se as they have infringed and the courts are allowing up to 3x the normal rate. I am not even close to that figure. I have invoiced about 8 businesses and bloggers so far and many are getting a discount on the invoice for paying early. If not they lose the discount. After 30 days it goes to the attorneys to deal with and I am out of it.
That is pretty much it. Most of the invoice discounts are 10-15 percent but some are getting more for various reasons. If they do things on their own to help the cause they get a bigger discount. The ones who do nothing get nothing in the form of a discount. Many infringers will not get billed but simply asked to remove the photo.
I have been contacted to file suit against Pinterest pinners for the preparation for a class action suit. I am not going to do that first, however I am going to put together a list and send invoices as people are also willing to help get their address for the invoices.
That is about as much as I am going to say about it. I am invoicing people, businesses and websites. It will continue and it will be for a fair and reasonable price if the invoice is promptly paid. I am not mentioning names or amounts, just to say all invoices so far are 4 -5 figures. The discounts run from 0 – 35 percent for fast or early pay.
I just put this article together right before posting as I was not anticipating a question like that.
