It is always interesting to see the emails that come in on various sites concerning the people who steal images and use them. I got one a while back that I finally deleted and removed from the servers. It was from an infringer who said to me asking them to pay for the use of the image is extortion. How funny is that? A thief and criminal saying it is extortion to get paid for the item they stole and used. This shows the true nature of that person. They can break the law and gain from using it but they think someone else should pay for it. I did respond to them and I will to any person who has infringed my work and does not want to pay for it. Go file charges against me for extortion. I will file criminal charges and copyright infringement and we will let law enforcement and the courts decide. I think it would be a very bad day for them. They took and used a duly registered copyrighted image, actually several of them, making the criminal charges a felony. I have never heard back but they are going to hear from me and be put on the list of infringers released with their name, their company name and according to the court decision listed in the other article their address. If you did not read it you should. Your home address has never really been private as it was published in phone books and given to a multitude of people and companies even now. So get used to it, names and addresses are not private and now it seems open to being published in articles.

As I have stated before, I do not submarine people or hit them in the back with something so I am putting together a letter to go out to all infringers that I have emails or physical addresses. I am posting this online for the others. I do not care how they feel about it as everyone that I can contact or reach has been told about the infringement and given the opportunity to correct it. The issue to some is they just do not feel they are required to pay for something, the motto of a thief. Some may think it is wrong to bill them, let them go to work for a month and not get paid and see how they feel about it. The billings I have done account for a licensing fee that has been published online since last year. The images are properly registered. The additional fees on some invoices are for the future legal fees to stop the damage they caused. A standard C&D letter is a thousand dollars. I have over two hundred infringements. Even if I have to go after two or three it will take a few thousand dollars as just writing the letter is not all. There is the response to deal with and maybe another letter and court issues if they happen. Then my time which is valuable to me anyway.
If a person thinks sending a notice about the legal consequences of infringement is extortion they need to look up the definition. Besides, the legal ramifications are not a threat from a person. If it is a threat from anyone it is the federal government. There are some very limited people who will try to make it fit, the same ones that say infringement is ok. They have one view, I can do what I want and no one can say anything about it. They are wrong. They are not being realistic, if you read signs at any store they say shoplifters will be prosecuted. There is no difference, either pay for the item you took or there will be consequences, that is not extortion under any definition. It is making a person pay for what they took.
Just for the new readers, the infringer mentioned here is just one of over 100 or more. This one has not been mentioned before as it will probably go to law enforcement and court. If you have read the other articles and figure this is the person mentioned as 32 you are mistaken. That person has decided that a court is the only way to decide this and will get her wish. She has decided by not returning the images for the library which it appears has to go through law enforcement first. The infringement and CMI issue has to be resolved by court order not by me or her without her being involved. She has chosen not to do that and the attorney and I have discussed her and all the issues so it is getting started. She will also be on the list as all others except those who are in process of working out a solution. Just remember, it is their responsibility to contact you after they have been notified. Do not chase them. They have responsibilities for taking what does not belong to them. If not, they probably do not care if they get sued or charges filed. The only other choice is to walk away and let them keep the library and get away with the infringement and CMI. In my case that will never be allowed.
