Anna Nicole Smith’s six-year-old daughter Dannielynn is entitled to sanctions against her mom’s husband’s estate estimated to be between $500 million and $1 billion and might inherit as much as $49 million. After a legal battle that has lasted for more than a decade, a California judge ruled on Wednesday that Anna Nicole Smith’s six-year-old daughter Dannielynn “is entitled to sanctions against Marshall’s family,” reported TMZ on May 30, 2013.
“The judge hasn’t specified the amount of the sanctions yet … but previously suggested they could run as high as $49 million.”
Anna Nicole Smith married oil tycoon J. Howard Marshall in 1994 when she was just 26 years old. Her husband was 89 years old. Only a year after having been married, oil tycoon J. Howard Marshall died.
Anna Nicole Smith, who was born on Nov. 28, 1967, as Vickie Lynn Marshall, dropped out of high school, became an American model, actress, and television personality, and became famous when she was the 1993 Playmate of the Year.
After her billionaire husband’s death, the young widow became involved in a legal battle over her husband’s estate that reached the U.S. Supreme Court. On May 1, 2006, after months of waiting for Anna Nicole Smith and her stepson Pierce, the U.S. Supreme Court handed down its ruling.
According to a May 1, 2006, The New York Times report, the U.S. Supreme court ruled in favor of Anna Nicole Smith.
“The former Playboy model Anna Nicole Smith was given a new chance by the Supreme Court today to try to get part of the vast fortune of her late husband, a Texas oil tycoon who was six decades her senior. The justices were unanimous in finding that Ms. Smith, who is also known as Vickie Lynn Marshall, could pursue her claim in federal court. The justices overturned a ruling by the United States Court of Appeals for the Ninth Circuit, which had held that the case really belonged in Texas state probate court.”
On Sept. 7, 2006, 11 years after J. Howard Marshall ‘s death on Aug. 4, 1995, Anna Nicole Smith’s daughter Dannielynn was born in Nassau, Bahamas. The Bahamian birth certificate recorded the father as Howard K. Stern. Anna Nicole Smith’s former lover and photographer Larry Birkhead claimed that Dannielynn was his daughter. Anna Nicole Smith’s younger half-sister claimed that Dannielynn was in fact J. Howard Marshall’s daughter and that Anna Nicole Smith had frozen his sperm before his death.
On April 10, 2007, Larry Birkhead was named the father of Dannielynn.
On Sept. 10, 2006, Anna Nicole Smith’s 20-year-old son Daniel Smith who was Dannielynn’s half-brother, died in his mother’s hospital room from a lethal combination of Zoloft, Lexapro and methadone.
On Feb. 8, 2007, only five months later, Anna Nicole Smith died of a “combined drug intoxication” according to her autopsy report, leaving Dannielynn to be the sole potential heir to her step-father’s estate.
And the legal battle continued.
In 2011, the U.S. Supreme Court ruled that Anna Nicole Smith’s estate, and thus her daughter Dannielynn, “was NOT entitled to any of J. Howard Marshall’s fortune — estimated between $500 million and $1 billion.”
On Wednesday, May 29, 2013, a California judge ruled that Anna Nicole Smith’s six-year-old daughter Dannielynn is entitled to sanctions against J. Howard Marshall’s family.
According to TMZ’s report, “the judge awarded the sanctions based on allegations that attorneys for Marshall’s estate used unsavory tactics throughout litigation … such as concealing crucial legal docs from Anna’s estate lawyers. … The judge hasn’t specified the amount of the sanctions yet … but previously suggested they could run as high as $49 million.”
Will and should Anna Nicole Smith’s daughter — Dannielynn Hope Marshall Birkhead — ever see any of the potential $49 million?
